How Consumer Rights Affect This Plan

The benefits conferred by this Plan are in addition to all rights and remedies provided under applicable consumer-protection laws and regulations. This Plan does not prejudice rights granted by applicable law, including statutory warranty rights and remedies for EXP PRO’s failure to perform its contractual obligations.

1. The Plan and Key Definitions

This contract (the “Plan”) governs the EXP PRO CARE services provided by EXP PRO. The Plan consists of these Terms and Conditions, the customer’s Plan Confirmation, and the original sales receipt for the Plan and Covered Equipment. The Plan Confirmation will be provided at purchase or sent automatically thereafter.

“Accidental Damage from Handling” or “ADH” means physical damage caused by an unexpected and unintentional external event, including a drop or liquid contact, that causes the Covered Equipment to fail or materially impairs its operation.

“Accidental Loss” means the unintended, involuntary, and permanent loss of possession of Covered Equipment at an identifiable time or during an identifiable period, supported by a credible description of the circumstances and reasonable efforts to locate it. Accidental Loss does not include abandonment, voluntary transfer, ordinary inventory shortage, or an inability to locate equipment without reasonably specific circumstances.

“Theft” means the unlawful taking of Covered Equipment without the customer’s consent and with intent to deprive the customer of it.

“Service Event” means a completed replacement under Hardware Service, ADH Service, or Loss and Theft Service. Technical Support that does not result in replacement is not a Service Event.

“Plan Term” means the fixed or monthly recurring coverage period stated in the Plan Confirmation. “Plan Year” means each rolling 12-month period beginning on the original Plan purchase date and each anniversary of that date.

2. Eligibility and Covered Equipment

The Plan covers the EXP48PRO Battery and EXP96PRO Battery identified by model, purchase record, and serial number when available in the Plan Confirmation (the “Covered Equipment”). Accessories, cords, chargers, solar panels, cases, and other items are not Covered Equipment unless expressly listed in the Plan Confirmation.

The Plan must be purchased with the Covered Equipment or within 14 calendar days after the Covered Equipment purchase. The customer must retain the Plan Confirmation and proof of purchase. Coverage applies only to Covered Equipment owned or lawfully possessed by the Plan purchaser or the recipient identified in the Plan Confirmation.

3. Plan Term, Payment, and Renewal

Coverage begins on the Plan purchase date unless the Plan Confirmation states a later date. Coverage continues through the end of the Plan Term unless cancelled or terminated under this Plan.

For a Monthly Plan, the recurring Plan Term is one month. The Monthly Plan automatically renews each month unless cancelled. The customer’s express affirmative consent to automatic renewal must be obtained and recorded during the sales process. Each renewal will be charged to the payment method on file at the original Plan price unless EXP PRO gives advance notice of a permitted price change.

For a Fixed-Term Plan, the term and price are those stated in the Plan Confirmation. EXP PRO is not obligated to offer renewal. If EXP PRO offers renewal, the renewal price and terms will be disclosed before renewal.

If a required payment cannot be collected and is not otherwise made when due, coverage may cease as of the due date. Acceptance of a late payment does not require EXP PRO to reinstate coverage retroactively unless EXP PRO confirms reinstatement in writing.

4. What Is Covered

4.1 Hardware Service for Defects or Battery Capacity

If, during the Plan Term, the Covered Equipment develops a defect in materials or workmanship, or its integrated rechargeable battery can hold less than 80 percent of its original specified capacity, EXP PRO will replace the Covered Equipment with a new or refurbished unit of the same model or a functionally equivalent model, subject to the exclusions and claim requirements in this Plan.

4.2 Accidental Damage from Handling Service

If, during the Plan Term, the Covered Equipment fails or is materially impaired because of ADH, EXP PRO will replace it with a new or refurbished unit of the same model or a functionally equivalent model.

ADH Service is limited to two Service Events during each Plan Year. Unused ADH Service Events expire at the end of each Plan Year and do not carry forward. At the start of the next Plan Year, two new ADH Service Events become available while coverage remains active.

4.3 Loss and Theft Service

If, during the Plan Term, Covered Equipment is subject to Accidental Loss or Theft, EXP PRO will provide one replacement with a new or refurbished unit of the same model or a functionally equivalent model, subject to validation of the claim and the requirements of this Plan.

Loss and Theft Service is limited to one Service Event during each Plan Year. An unused Loss and Theft Service Event expires at the end of the Plan Year and does not carry forward. This limit is separate from the two ADH Service Events described in Section 4.2 unless the Plan Confirmation provides a more generous benefit.

No deductible or service fee applies to Loss and Theft Service unless the exact fee was conspicuously disclosed to the customer in the Plan Confirmation before purchase. Loss and Theft Service provides replacement equipment only and does not provide a cash payment, reimbursement for replacement purchased elsewhere, or compensation for accessories, data, travel interruption, lost use, or consequential expenses.

A covered Accidental Loss or Theft may occur anywhere in the world. EXP PRO will ship a replacement only to an eligible delivery address in the 50 United States or District of Columbia, unless EXP PRO agrees otherwise in writing. The customer is responsible for any customs, duties, taxes, forwarding charges, or international transportation not expressly accepted by EXP PRO.

4.4 Priority Technical Support

During the Plan Term, EXP PRO will provide priority access to telephone and web-based technical support for Covered Equipment. Support may include installation, configuration, troubleshooting, and determining whether Hardware Service or ADH Service may apply. Technical Support does not include medical advice, clinical settings advice, or a guarantee of uninterrupted therapy.

5. What Is Not Covered

The Plan does not cover normal wear and tear; cosmetic damage that does not affect operation; preventive maintenance; consumable parts; accessories not listed as Covered Equipment; damage caused by a product that is not Covered Equipment; damage caused by reckless, abusive, willful, or intentional conduct; or use materially inconsistent with published EXP PRO instructions.

Hardware Service and ADH Service do not cover pre-existing conditions; equipment opened, serviced, modified, or altered by anyone other than EXP PRO or an authorized representative; or damage caused by unauthorized parts or repairs when the unauthorized work caused or materially contributed to the claimed failure.

Loss and Theft Service does not cover voluntary transfer or parting with the equipment, lending or renting the equipment without reasonable recovery arrangements, abandonment, confiscation or seizure by a government or carrier, loss caused by war or civil disorder, ordinary inventory shortage, commercial shipment loss before delivery to the customer, or a claim based only on an unexplained inability to locate the equipment.

No service is available for a fraudulent claim, material misrepresentation, intentional disposal, staged theft, deliberate loss, alteration or concealment of identifying information, or failure to provide information reasonably necessary to validate the claim. A simple mistake or immaterial omission does not by itself void coverage.

The Plan does not cover bodily injury, medical expenses, therapy interruption, lost profits, lost data, loss of use, substitute equipment rental, transportation, lodging, or other indirect, incidental, special, or consequential loss, except where exclusion is prohibited by law.

6. How to Make a Claim

The customer may request service by calling EXP PRO at 360-718-2862, option 1, or emailing orders@exppropower.com. The customer should report a claim as soon as reasonably possible and no later than 30 days after discovering the event. A reasonable delay will not defeat a claim when circumstances prevented timely notice and the delay did not materially prejudice EXP PRO’s ability to investigate.

For every claim, the customer must provide the Plan Confirmation, proof of purchase for the Plan and Covered Equipment, contact information, the Covered Equipment serial number when available, and a truthful description of the event and requested service.

For Theft, the customer must report the incident promptly to the appropriate law-enforcement or responsible local authority when reasonably obtainable and provide the report number or a copy of the report. If a report cannot reasonably be obtained, the customer must explain why and provide alternative evidence reasonably requested by EXP PRO.

For Accidental Loss, the customer must provide a signed statement describing the date or estimated period, place, circumstances, last known possession, and reasonable steps taken to locate the Covered Equipment. EXP PRO may request travel records, carrier reports, communications, photographs, or other non-privileged information reasonably related to claim validation.

EXP PRO may require a remote interview, additional documentation, or return of damaged Covered Equipment. Requests will be proportionate to the claim and handled in accordance with applicable privacy law. EXP PRO will not require a customer to waive consumer rights as a condition of receiving covered service.

7. Service Options and Replacement Fulfillment

EXP PRO may provide mail-in service, advance replacement, or another reasonable service option. For mail-in service, EXP PRO will provide shipping instructions and, when stated in the authorization, prepaid shipping within the United States. The customer must follow the instructions and return all requested components.

A replacement may be new or refurbished and may be the same model or a functionally equivalent model. A replacement will have functionality and capacity reasonably comparable to the Covered Equipment, but color, cosmetic condition, included accessories, or exact model generation may differ. The original manufacturer warranty, statutory rights, and this Plan continue as provided by their respective terms.

When EXP PRO replaces Covered Equipment under Hardware or ADH Service, title to the returned equipment transfers to EXP PRO and title to the replacement transfers to the customer. When EXP PRO replaces Covered Equipment after Loss or Theft, title to the missing or stolen equipment transfers to EXP PRO to the extent permitted by law.

If lost or stolen Covered Equipment is recovered after replacement, the customer must notify EXP PRO within 10 days and follow reasonable return instructions. EXP PRO will provide prepaid return shipping within the United States. The customer may keep the recovered equipment only if EXP PRO agrees in writing and the customer pays the amount specified by EXP PRO, which will not exceed the replacement’s fair market value.

Coverage transfers to the authorized replacement and continues for the remainder of the Plan Term. The replacement does not restart or extend the Plan Term or reset annual Service Event limits.

8. Customer Responsibilities and Claim Integrity

The customer must take reasonable care of Covered Equipment, maintain accurate contact and payment information, retain proof of purchase, respond to reasonable information requests, and follow service and shipping instructions. The Plan does not require preventive maintenance unless the requirement is stated conspicuously in the Plan Confirmation and permitted by law.

The customer must not conceal material facts, submit altered records, transfer the same Plan among multiple devices, or seek duplicate recovery from EXP PRO and another protection provider for the same replacement. EXP PRO may deny a claim supported by substantial evidence of fraud or material misrepresentation and may pursue recovery of replacement equipment or costs as permitted by law.

EXP PRO will explain a denied claim in writing, identifying the relevant Plan provision and the principal reason for denial. The customer may request reconsideration by providing additional information within 30 days after the denial notice.

9. Cancellation

The customer may cancel the Plan at any time by calling 360-718-2862, emailing orders@exppropower.com, using an available subscription-management tool, or sending written notice to Agreement Administration, 107 E 7th St, Vancouver, WA 98660.

If the Covered Equipment is returned under the original seller’s return policy and the Plan is cancelled, the customer will receive a full Plan refund. For a Monthly Plan cancelled without a return of Covered Equipment, coverage continues through the end of the paid monthly period unless applicable law requires otherwise; no partial-month refund is provided unless required by law.

For a Fixed-Term Plan, any cancellation refund will be calculated as required by the Plan Confirmation and applicable law. If the Plan Confirmation does not state a lawful method, EXP PRO will provide at least a pro-rata refund for the unused term, less the value of services paid when deduction is permitted by law.

EXP PRO may cancel the Plan for nonpayment, fraud, or material misrepresentation. EXP PRO may also cancel when replacement parts or equipment are no longer reasonably available, subject to advance notice and any pro-rata refund required by law. Cancellation does not reduce rights or obligations that accrued before the effective cancellation date.

10. Plan Changes and Existing Customers

The terms issued to a customer remain in effect for that customer’s Plan Term and each Monthly Plan renewal unless EXP PRO changes them using the notice and consent process required by the Plan and applicable law. EXP PRO may revise price, service fees, or terms upon at least 60 days’ written notice, or any longer period required by law.

A revision that broadens coverage without additional cost or increased service fees may apply immediately when permitted by law. Adding Loss and Theft Service to an existing Plan is intended to broaden coverage; however, EXP PRO will not represent that the revised benefit applies retroactively until it has completed any required notice, consent, filing, or operational steps and has communicated the effective date to the customer.

If a customer does not agree to a change, the customer may cancel without penalty during the applicable notice period. Continued payment or a request for service after legally sufficient notice may constitute acceptance only where permitted by law.

11. General Terms

EXP PRO may subcontract or assign performance but remains responsible for its obligations under this Plan. EXP PRO is not responsible for a delay caused by events outside its reasonable control, but will resume performance as soon as reasonably practicable.

This Plan is offered and valid only in the 50 United States and District of Columbia and is unavailable where prohibited. A purchaser must have reached the age of majority. Support may be available in English only.

EXP PRO may record service calls for quality and training when permitted by law and with any required notice or consent. Information collected for claims and service will be handled under the EXP PRO Privacy Policy and applicable law and may be shared with service providers only as reasonably necessary to administer the Plan, prevent fraud, or comply with law.

The Plan, Plan Confirmation, and original sales receipt constitute the parties’ entire agreement regarding the Plan and prevail over conflicting purchase-order terms. A sales representation that is expressly incorporated into the Plan Confirmation is part of the Plan. Nothing in this clause excludes rights or remedies that cannot lawfully be waived.

If any provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision once is not a waiver of future enforcement.

Except where prohibited by law, California law governs the Plan without regard to conflict-of-law principles. Mandatory consumer-protection and service-contract laws of the customer’s state continue to apply. There is no required informal dispute-settlement process under this Plan, but the customer may request claim reconsideration under Section 8.

Notices to EXP PRO may be sent to orders@exppropower.com or Agreement Administration, 107 E 7th St, Vancouver, WA 98660. EXP PRO may send notices to the email or mailing address in the customer’s Plan record. The customer should keep that information current.
